The longer a couple is married, the more difficult it can be to equitably divide their assets during a divorce. The division of assets can be determined by mutual agreement, often with the assistance of a mediator, or through judicial decree. What Is Considered Marital Property?
In Alabama, any property that is obtained by either spouse while they are married is considered marital property. There are only a few exceptions to this rule. Additionally, property that was individually owned prior to marriage can become marital property during the course of a marriage.
Exceptions to normal marital property rules include:
- An inheritance individually received by either spouse
- A third-party gift individually received by either spouse
- Compensation related to a personal injury reward
Property that began as separate property can become marital property if the other spouse it titled in or it is deposited into a joint account. A divorce lawyer can help you better understand the differences between separate property and marital property.
